The mission of Rummage Marketplace is two-fold:

1. Provide individuals (i.e., Sellers) a forum to advertise their self storage lien sales, rummage sales, auctions, yard sales, estate sales and any other local sale event

2. Arm individuals (i.e., Buyers) with comprehensive and up-to-date information so they can make informed decisions about attending these sale events

Rummage Marketplace does not represent or warrant, either by implication nor express statement, the accuracy or completeness of the information contained in or photos attached to a sale listing (‘Content’), or the information contained in other sources referenced in the Content such as website links. Warranties or representations can only be made by the individual, business or other entity that posted the Content. Prospective individuals reviewing the information contained in the Content are encouraged to perform such independent due diligence as he or she deems appropriate to ensure the accuracy and validity of the statements made in the Content.

Although Sellers may choose to utilize Rummage Marketplace with the intention of satisfying local or State public notice requirements prior to conducting certain types of sales (such as a lien sale), Rummage Marketplace does not represent or warrant that such usage is permissible or what information the public notice must contain to be permissible. It is the responsibility of Sellers to review their local and State laws and statutes to determine permissibility.

By using Rummage Marketplace individuals agree to hold Rummage Marketplace harmless of any loss or damages arising from the use of the Rummage Marketplace website. If a dispute shall arise between individuals over Content, the individuals will resolve it amongst themselves and Rummage Marketplace has no obligation to get involved.

Rummage Marketplace reserves the right to remove any Content it believes undermines the mission of the web site, is facilitating harm onto others (either intentional or unintentional), is misleading, or is inappropriate. In the event Content is removed for violating the terms and conditions of Rummage Marketplace, any fees paid to post the Content will be forfeited and are non-refundable.

TERMINATION OF SERVICE

Rummage Marketplace reserves the right to terminate access to person(s) violating the terms and conditions. In addition, person(s) agree not to attempt to use the service after being terminated.

In the event that an individual has their Rummage Marketplace access terminated, any fees paid to post Content will be forfeited and are non- refundable.

PRIVACY

By using Rummage Marketplace, you agree that Rummage Marketplace may, in its sole discretion, preserve or disclose your Content, as well as your contact information (e.g., email addresses, IP addresses, timestamps, phone numbers, addresses and and other user information), if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:
• Comply with the law or legal process
• Enforce our terms and conditions
• Respond to claims that any Content violates the rights of third- parties
• Respond to claims that contact information of a third-party has been posted or transmitted without consent or as a form of harassment
• Protect the rights, property, or safety of Rummage Marketplace, its users or the general public.

LIMITATIONS OF SERVICE

Rummage Marketplace reserves the right to suspend or cease the service with or without notice and shall not be liable to you or any third party for suspension or discontinuance.

LIMITATIONS OF LIABILITY

Under no circumstances shall Rummage Marketplace be held liable for any damages, be it direct, indirect, incidental, special, consequential or exemplary, resulting from any aspect of your use of the Rummage Marketplace site regardless of whether the damages arise from use or misuse of the Rummage Marketplace site, from the inability to use the Rummage Marketplace site, from Content shown on or provided by the Rummage Marketplace site or the interruption, suspension, modification, alteration or termination of the Rummage Marketplace site

DAMAGES

In the event that these terms and conditions are violated, Rummage Marketplace reserves the right to seek reasonable damages from the person(s) committing the violation in order to pay for Rummage Marketplace’s legal fees, the time and effort to both investigate and respond to the violation as well as compensation for the degradation of the Rummage Marketplace brand.
